Terms of Use

These Terms of Use ("Terms") apply to the myDynasty mobile application ("the app", "myDynasty") for iPhone and iPad, published in the App Store, and for Android, published on Google Play, including the optional myDynasty Premium subscription. By installing or using the app you agree to these Terms. If you do not agree, please do not use the app.

1. About the app

myDynasty is a family tree and family memory app. It lets you build a visual family tree, attach photos and documents, record biographies, map places and burial sites, and import or export your data. The app does not require an account or registration.

Your family data — names, dates, photos, places, stories and documents — stays on your device, and we do not have a copy of it. Nothing from your tree leaves the device unless you export or share it yourself, or use a function that needs the internet: a map, the cemetery directory or an AI feature. When you use an AI feature, the content you choose to send goes to our server and from there to OpenAI, and only after you have agreed on that feature's consent screen. The Privacy Policy explains what each function sends and to whom.

2. App Store and Google Play terms

• iPhone and iPad. Apple's Standard Licensed Application End User License Agreement (the "Apple EULA") applies to the app. These Terms supplement the Apple EULA. If they conflict, the Apple EULA prevails for the iPhone and iPad app.
• Android. The Google Play Terms of Service apply to downloading the app and buying the subscription on Google Play. These Terms supplement them.

3. Your data and your responsibility

• You own the information you enter. It is stored on your device.
• You are responsible for the content you add and for having an appropriate basis or consent to record information about other people — especially living relatives — in line with applicable law.
• Because data is stored on your device, you are responsible for keeping your own backups. The app keeps its data out of iCloud and computer backups on iPhone and iPad and out of Android's automatic cloud backup, so exporting is how you keep a copy outside the device. You can export your tree at any time to GEDCOM, LRV, SVG or PNG.
• If you share an exported file with others, you are responsible for how and with whom you share it.

4. Free version and Premium subscription

The app is free to download. The free version includes 1 family tree, 1 gallery, up to 50 people per tree and up to 25 archive files per project, with maps, photos and GPS. Importing and exporting your tree (GEDCOM, LRV, SVG, PNG) is free for everyone (on Android, from version 1.0.16); what you import counts toward the limits of your version. On iPhone and iPad, projects created before version 1.0.15 keep working without these limits.

myDynasty Premium (mydynasty_premium_monthly) is an optional auto-renewing monthly subscription. On iPhone, iPad and Android it includes:

• the AI assistant (section 5): add relatives by telling their story by voice, read headstone inscriptions from a photo, restore old photos (4 per month; unused restorations carry over, up to 16) and get help with biographies;
• more room: up to 5 family trees, 5 galleries, 500 people per tree and 500 archive files per project;
• navigation to burial sites.

• Price: shown in the App Store or on Google Play before you buy. Prices can differ by country, for example because of local taxes.
• Billing: on iPhone and iPad, the subscription is sold through the App Store and charged to your Apple Account under Apple's terms. On Android, it is sold through Google Play and charged to your Google account under Google's terms. Apple and Google handle the payment; we never receive your card details. There is no free trial.
• Renewal: the subscription renews automatically every month until you cancel it. On iPhone and iPad, cancel at least 24 hours before the end of the current period to avoid the next renewal.
• Cancellation: manage or cancel the subscription at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current paid period; Premium stays active until then.
• After Premium ends: nothing is deleted. Projects above the free limits become read-only until you subscribe again — you can still view and export them — and AI features stop.
• Refunds: handled by Apple or Google under their refund rules.
• Accounts and devices: Premium is linked to the Apple Account or Google account you buy it with; there is no separate account in the app. Use "Restore purchases" on a new device or after reinstalling. A subscription bought in the App Store does not unlock Premium in the Android app, and one bought on Google Play does not unlock it on iPhone or iPad. On iPhone and iPad, the subscription is not shared through Family Sharing.
• Availability: Premium and its features may not be offered in every country.

5. AI features

AI features ("Capybara AI") are part of Premium on iPhone, iPad and Android.

• Only with your consent. Before an AI feature first sends your content, it shows a consent screen that lists what will be sent. No voice, photo or text is sent until you agree. What you send goes to our server and from there to OpenAI, as described in the Privacy Policy. You can withdraw your consent at any time in Settings → "Capybara AI" → "Withdraw consents". Withdrawing consent does not cancel the subscription, and the extra room that Premium gives does not depend on agreeing to AI.
• Monthly allowance. Each subscription includes a monthly AI allowance, shared by all devices that use the subscription. Photo restorations are counted separately: 4 per month, and unused ones carry over, up to 16. If the allowance or the restorations run out, the features concerned pause until the next monthly period; the rest of the app keeps working. Settings → "Capybara AI" shows what is left.
• AI can be wrong. It may mishear or misread names, dates, places and relationships, or add details that are not true. Check names, dates and places before you save the result.
• Restored photos are created by AI. A restored photo is a new image generated by AI. It may differ from how the person really looked, and it is not an original document. The original photo stays in the app.
• Reporting a result. You can report an AI result in the app with "Report this result"; the report goes to us as described in the Privacy Policy.
• Content you send. Send only content you have the right to share: photos you may use, and information about other people that you may lawfully share. Take particular care with details about living people, especially children.
• Lawful use. Do not use AI features for anything unlawful or to infringe the rights of others, such as their privacy or copyright.
• Availability. AI features depend on our server and on OpenAI. They may sometimes be unavailable or limited, for example during an outage or when the daily capacity of the service is reached.
• Age. AI features and the subscription are for people aged 13 or over. Where the law of your country sets a higher age for consenting to online services, younger users need the permission of a parent or guardian.

6. Acceptable use

• Do not use the app for unlawful purposes or to infringe the rights of others.
• Do not attempt to misuse, disrupt or reverse engineer the app or our server beyond what applicable law expressly permits.
• Do not try to get around the subscription, the AI allowance or the limits of the free version.

7. Third-party services

Some functions use services that other companies provide to you under their own terms and privacy policies:

• Apple (iPhone and iPad): the App Store, Apple Maps, address search and speech recognition;
• Google (Android): Google Play, Google Maps, address search and speech recognition;
• OpenStreetMap Foundation: map images for the cemetery map and for the small maps in burial records.

AI features use OpenAI, which processes the content you send on our behalf. What each service receives is described in the Privacy Policy.

8. No professional advice

Optional personal or medical notes you may store are for your personal record-keeping only. They are not medical, legal or professional advice, and neither are the results of AI features.

9. Disclaimer

To the maximum extent permitted by applicable law, the app, including Premium and AI features, is provided "as is" and "as available", without warranties of any kind. We do not warrant that the app will be uninterrupted or error-free, that AI results will be accurate, or that the app will meet every expectation.

10. Limitation of liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental or consequential damages, or for loss of data. Because your data is stored on your device, keeping your own exported backups is your responsibility.

11. Changes

The app and these Terms may be updated over time. Material changes will be reflected on this page with a new effective date and version number; the previous version stays available through the link at the end of this page. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.

12. Governing law and provider

The app is provided by Roman Lobko, a private individual based in Ukraine. He is the seller of myDynasty and of the myDynasty Premium subscription in the App Store and on Google Play. These Terms are governed by the laws of Ukraine, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
